Terms & Conditions of Sale

Testament is an online gallery operated by Things Change Ltd. These terms govern the sale of original artworks and limited edition prints by Simon Fletcher purchased through our online platform.

By placing an order you agree to these terms. Please read them before you buy.

 

1. Who you are buying from

The seller is Things Change Ltd ("we", "us", "Testament"), a company registered in England and Wales.

The sales platform is provided by Art Logic. Your contract of sale is with Things Change Ltd, not with Art Logic.

We are not currently VAT registered. Prices shown include no VAT element and no VAT will be added at checkout.


2. The works

We sell two categories of work:
Originals. Unique works by Simon Fletcher. Each is one of a kind. We represent Simon Fletcher and sell these works with his authority.

Limited edition prints. Produced in a stated, closed edition. For each edition we will state:

- the medium and printing process
- the edition size and the number of any artist's proofs (APs)
- whether the work is signed and/or
- numbered by the artist the paper or substrate and the image and sheet dimensions

Once an edition is sold out it is closed. We will not reprint a closed edition at the stated size.

Colours and surface qualities shown on screen are a guide only. Screens vary, and reproductions of hand-finished or printed work will differ slightly from the physical piece. Minor variation is a characteristic of the work, not a defect.


3. Authenticity

Each original and each limited edition print is supplied with a Certificate of Authenticity identifying the work, the artist, the edition details where relevant, and the date of sale. Keep this – it forms part of the work's provenance and may be needed on any future resale.

 

4. Price and payment

Prices are in [GBP £] and are shown on each work's page.

Payment is taken in full at the time of order through the platform's payment provider. We do not store your card details; payment is handled by the provider's secure systems. Title to the work does not pass to you until we have received payment in full.

We make every effort to price works correctly. If a work is listed at a clearly incorrect price due to an error, we may cancel the order and refund you in full before despatch.

 

5. Shipping and delivery

We will confirm shipping costs and method before you complete your order, or state them on the work's page.

We aim to despatch within 14 day working days of cleared payment, unless the work is framed to order or otherwise stated.

Original works and larger pieces are shipped by specialist fine-art couriers.

Risk in the work passes to you on despatch to the address you give us.

If you are buying from outside the UK, you are responsible for any import duties, taxes, or customs charges in the destination country.

We are not liable for delays caused by carriers, customs, or events outside our reasonable control.

 

6. Your right to cancel (consumer orders)

If you are buying as a consumer (not for business purposes), you have the right under Consumer Contracts Regulations to cancel your order within 14 days of receiving the work, without giving a reason.

To cancel, tell us in writing at hello@testament.gallery within that period. You must then return the work to us within 14 days of telling us.

The work must be returned in its original condition and packaging.

You are responsible for the cost and safe return of the work, and for insuring it in transit. We recommend the same level of fine-art handling used to ship it to you.

We will refund the price paid, and the standard outbound delivery cost, within 14 days of receiving the work back /or of you providing proof of return). We may reduce the refund to reflect any loss in value caused by handling beyond what is necessary to examine the work.

This right does not apply to works made or personalised to your specification (for example, bespoke framing).

 

7. Damaged or faulty works

If a work arrives damaged, or is not as described, contact us at hello@testament.gallery within 14 days of delivery with photographs. This is separate from and in addition to your cancellation rights above and your statutory rights under the Consumer Rights Act 2015.

Where a work arrives damaged we will, at your option and subject to availability, arrange repair, replacement (for editions), or a full refund including return shipping.

 

8. Copyright and reproduction

Copyright in all works remains with Simon Fletcher. Buying a work transfers ownership of that physical object only. It does not transfer any copyright or reproduction rights.

You may not reproduce, copy, or commercially exploit the image of the work without the artist's written permission. You may resell the physical work.

 

9. Artist's Resale Right

Original works and signed limited editions by a living artist may be subject to the Artist's Resale Right on qualifying resales above the statutory threshold, payable to the artist via a collecting society. Where this applies to a sale through us, it will be identified at the point of sale. 

 

10. Our liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

Subject to that, our total liability for any work is limited to the price you paid for it.

 

11. Privacy

We handle your personal data in line with our Privacy Policy and UK data protection law. We use your details only to process and deliver your order and to contact you about it.

 

12. General

These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales.

If any part of these terms is found unenforceable, the rest continues to apply.
